WASHINGTON (AP) ? The discovery that a fake version of the widely used cancer medicine Avastin is circulating in the United States is raising new fears that the multibillion-dollar drug-counterfeiting trade is increasingly making inroads in the U.S.
The criminal practice has largely been relegated to poor countries with lax regulations. But with more medicines and drug ingredients for sale in the U.S. being manufactured overseas, American authorities are afraid more counterfeits will find their way into this country, putting patients' lives at risk.
The Avastin discovery follows other recent instances in the U.S. of counterfeiting, involving such drugs as Viagra, the cholesterol medicine Lipitor and the weight-loss pill Alli.
"We do know there are counterfeits continuing to try and make their way onto the U.S. supply chain," said Connie Jung, an associate director in the Food and Drug Administration's office of drug security.
The FDA announced Tuesday it is investigating fake vials of Avastin that were sold to at least 19 doctors and clinics, including 16 sites in California, two in Texas and one in Chicago. Tests showed the vials did not contain the active ingredient in Avastin, which is given intravenously in hospitals, clinics and doctors' offices to treat several types of cancer.
The contents of the vials are still being analyzed, and the FDA said it has not received any reports of patients who were harmed.
FDA officials said the counterfeit Avastin was imported from Britain and distributed by Volunteer Distribution, a wholesaler based in Gainesboro, Tenn. British regulators notified the FDA about the products in December, but the agency didn't confirm they were fake until last week.
The FDA gave assurances Wednesday that the U.S. remains one of the most secure pharmaceutical markets in the world. But the news sent cancer doctors scrambling to check their records.
Mary Mathias, a nurse who orders drugs for one doctor on the FDA list ? Dr. Phillip L. Chatham in Granada Hills, Calif., ? said they had stopped using the company in question at least a year ago.
Because Avastin treatments are spaced one to two weeks apart, it is not likely that someone would get more than one infusion from the same vial. And because these are people facing a life-threatening disease, it is hard to say whether missing one treatment with the real drug would compromise their care.
Gauging harm from a counterfeit cancer treatment is nearly impossible, said Dr. Robert C. Young, former president of the Fox Chase Cancer Center in Philadelphia and now a consultant to cancer centers.
A colon cancer patient, for example, might receive 18 to 20 Avastin infusions over six months. Missing one dose seems unlikely to have a dramatic effect on survival odds, but it's not provable either way because cancer's course and a patient's response to treatment are not predictable, he said.
Counterfeits have traditionally been more of a concern in developing regions like Asia and Latin America, where as many as 30 percent of drugs sold are fake, according to the World Health Organization. The group estimates just 1 percent of drugs dispensed in the U.S. and other developed nations are fake.
But incidents of counterfeiting reported by drugmakers have increased steadily over the decade to more than 1,700 worldwide last year, though only 6 percent of those were in the U.S. There are few reliable estimates on the value of the global counterfeit drug trade, though most place it in the tens of billions.
Counterfeiting has become more prevalent as pharmaceutical supply chains increasingly stretch across continents. Over 80 percent of the active ingredients used in U.S. pharmaceuticals are now manufactured overseas, according to a recent congressional report, and experts say this has made it easier to move counterfeit products into this country.
"With today's transportation networks, it's no longer a stretch to move these materials from a source in Pakistan or India to the U.S." said Tom Kubic, president of Pharmaceutical Security Institute, a trade association set up by two dozen pharmaceutical companies.
In 2005, federal prosecutors indicted 11 employees of a Missouri business on charges of conspiring to sell $42 million in counterfeit Lipitor. It was manufactured in Costa Rica and illegally imported to the U.S., where it was sold to wholesalers.
Industry experts also say a combination of big profits and low penalties has made drug counterfeiting an increasingly attractive business for criminals in the U.S. and abroad.
A single vial of Avastin sells for $2,400, and the drug had nearly $2.7 billion in U.S. sales last year, while the sentence for drug counterfeiting in the United States is about three years in prison. That compares with 15 years for counterfeiting money.
John Clark, head of global security for Pfizer Inc., said counterfeiters can make several million dollars quickly and, if they're caught, get off with as little as six months in jail. He also said counterfeiters can set up an operation at a fairly low cost ? perhaps $50,000, including about $20,000 for a pill press.
"It's a no-brainer for criminal organizations that it's worth a gamble," Clark said.
Clark said Pfizer's anti-counterfeiting team around the world has seen a number of fake vaccines and biologic drugs sold in developing countries, not just pill-based drugs.
"They're getting much more sophisticated," often getting ahold of legitimate vials that had held such medicines, from patients, trash cans or recycling operations, and then filling them with oil or water.

Arizona's plan to fire teachers for swearing… outside the classroom (The Week)
New York ? A group of conservative lawmakers say their bill will protect kids from profanity in the classroom. But critics say they're going way too farPublic school teachers might soon have to be extra careful about what they say both in and out of class. A group of Republican state lawmakers is trying to pass a bill requiring teachers to avoid using offensive language in front of their students. Free speech advocates, predictably, aren't crazy about the idea and point out that the bill is so poorly written that it inadvertently puts limits on what teachers could say in their own homes. Here, a brief guide:
What words do the lawmakers want to ban?
The bill would bar teachers from using any words that the Federal Communications Commission regulations bar from TV and radio, which generally include both the F-word and milder terms like "shit." The standards, however, are a bit vague, as the FCC says words that might be OK in some contexts aren't in others. The agency defines profanity as "language so grossly offensive to members of the public who actually hear it as to amount to a nuisance."

How would teachers who break the rule be punished?
As the bill is currently written, a first offense would trigger a one-week suspension (although the penalty might be reduced to a simple warning). A second offense would result in a two-week suspension. Any teacher busted for a third offense would be fired.
Is profanity a big problem in the classroom?
One of the bill's sponsors, state Rep. Lori Klein, says constituents have been complaining about high school teachers using inappropriate language in front of students. "Students are young and impressionable and teachers should not be using four-letter words in the classroom," she says. But a veteran high-school French teacher, Chris Maza, says teachers already know to keep classrooms G-rated. "I don't find this to be such a significant issue that we would have to have a law," Maza tells The Arizona Republic.

But, wait, what about free speech?
That's the biggest problem critics have with this proposal. It's bad enough that this "absurd" law would prohibit high school teachers from exposing students to great works of literature that happen to include "salty language," says Erin Gloria Ryan at Jezebel, but the proposed ban extends even to college professors. And that's not the worst of it, says Angus Johnston at Student Activism. The bill is so badly worded that, in its current form, it would ban swearing in scholarly articles, private emails, and even, technically, make it a no-no for teachers to swear ? or take off his or her clothes ? anywhere, even at home. "Just when you thought the Arizona legislature was out of bad ideas."

Barbara Coombs Lee: The Schiavo Case Seven Years Later

Sometimes progress toward human dignity seems agonizingly slow, especially affirming the role of choice at the end of life. So it's heartening when evidence of seismic change shows up. Last week's presidential debate lifted our hearts for this reason.
Contenders for the Republican nomination were in Tampa, and questioners brought up Terri Schiavo. Mrs. Schiavo, you'll recall, had been in a permanent vegetative state for fifteen years in 2005, when the family's conflict over whether she would want continued artificial feeding rocked the state of Florida and riveted the nation. State courts had already ruled repeatedly and consistently that the tube feeding should be discontinued, consistent with her expressed wishes prior to the event that rendered her insensate.
Politicians in Florida and Washington, D.C., were convinced voters wanted them to intervene in the tragic deliberations of the divided family. Procedural manipulations and governmental excesses stoked a spectacle of controversy for years. The litany of hearings, re-hearings and appeals is too long to recite here. Toward the end Congress went to extraordinary lengths to override Florida state courts. They issued a subpoena for the vegetative Mrs. Schiavo to appear at a hearing and passed a special law to override jurisdiction of the state, placing the case back in the federal court that had repeatedly deferred to its state counterpart. All the lawmakers believed in states' rights, of course.
Senator Frist, a cardiac surgeon, assessed Mrs. Schiavo's neurological function from the Senate floor via a short video clip of her head movements. Posturing, sanctimonious politicians of all stripes declared their devotion to life and their outrage that a feeding tube could be considered futile medical treatment.
On March 20, 2005, the New York Times front page reported, "Congress Ready to Approve Bill in Schiavo Case," and detailed the fervor that had seized that august body. Mine was a lone voice of alarm in the article. "'In this political climate, with this kind of thing going on in Congress, everyone must take steps to protect themselves -- making an advance directive, documenting their wishes, making sure their loved ones know about them,' said Barbara Coombs Lee, CEO of Compassion & Choices. ... 'The greatest fear of our constituents is that other people -- complete strangers -- will make end-of-life decisions for them,' Ms. Lee added. 'And God forbid that it would be politicians.'"
I've always been proud of that quote. Because as it turned out, most of the nation agreed with me. Congress did pass the bill, in the middle of the night on Palm Sunday, and President Bush flew overnight from Texas in his jammies to sign it 30 minutes later. Nevertheless, federal courts followed the law, refrained from intervening, and Schiavo died peacefully on March 31.
One month later Harris polled Americans on how they viewed the Schiavo debacle. Congress fared worst, with 58 percent of respondents saying they disapproved of Congress's behavior. Only 35 percent approved. Florida lawmakers fared almost as badly, with 57 percent disapproval, 33 percent approval. The president and governor came off little better.
In May 2005, The New York Times Magazine published an in-depth profile of Rick Santorum. It reported that Santorum was one of the lead senators urging federal intervention in the Terri Schiavo case. He told the author that he informed Bill Frist, the majority leader, that he (Santorum) would keep the Senate in session through its Easter break if lawmakers tried to adjourn without first intruding in the Schiavo case. Santorum is quoted, ''I said to the leader: 'We're not leaving here until we pass this.'"
Fast-forward to last month's debate in Tampa. The political calculation has changed drastically in seven years, and Santorum backs away substantially from his enthusiasm of 2005. In Tampa he asserted that he "did not call for congressional intervention." Rather, "I called for judicial intervention on behalf of the parents."
Oh, I see the difference! But after seven years, 14 appeals, five federal lawsuits and three denials from the U.S. Supreme Court, only an Act of Congress could have prolonged the courtroom circus any further. That is what Santorum fought for, and that is what the people judged unseemly meddling. In contrast, last month Santorum even affirmed the morality of refusing resuscitative efforts, adding, "I think that's a decision that people should be able to make."
Santorum's fellow debaters chimed in with updated political messaging. Newt Gingrich went so far as to say the whole Schiavo controversy "has nothing to do with whether or not you as a citizen have a right to have your own end-of-life prescription, which is totally appropriate for you to do as a matter of your values in consultation with your doctor." It's anybody's guess whether Gingrich really supports the medical practice of aid in dying; but on its face, his statement would resonate with the 70 percent of Americans who do.
Ron Paul said the Schiavo case was "way out of proportion" and he would have preferred to see the decision made at the state level, which, of course, is where it was ultimately made.
I don't pull up this history to accuse politicians of insincerity or point out inconsistencies. I just want folks to notice that our nation has changed, and expectations of our politicians have changed when it comes to end-of-life decisions.
Seven years ago it was different. But today we expect politicians to stay out of the personal end-of-life choices we make, in consultation with our physicians and consistent with our own beliefs and values. We expect the people we elect to show some respect for the heartbreaking decisions families make every day at the bedsides of their loved ones. Politicians should not limit those choices arbitrarily and should never seek to impose their own moral judgment on complex deliberations in a religiously diverse nation.
